Both the Plaintiff and the Defendant were tenants in the building that caught fire and resulted in the complete destruction of the premises. The Plaintiff sued for property damage and business interruption losses as a result of a fire allegedly caused by the Defendant’s negligence in failing to connect a fire suppression bypass system to a newly installed fryer. A Co-Defendant was also alleged to be negligent in failing to shut down the establishment after an inspection noted that the bypass system was not connected. After a four-day trial the jury returned a defense verdict.
